1. Organiser These Terms are issued by National Media Pty Ltd (ABN 94 121 601 394) (“we”, “us”, “our”), the organiser of AusFitness Expo and AusFitness Industry Trade Show & Summit and its associated events.
2. Acceptance of Terms By registering to attend AusFitness Expo or AusFitness Industry or any associated event (“the Event”), you agree to comply with and be bound by these Terms and Conditions (“Terms”). These Terms apply to all registrants, whether attending for free or by paid ticket.
3. Eligibility and Entry Requirements
- AusFitness Industry is strictly for trade professionals working in the fitness industry. Proof of industry affiliation may be required.
- Individuals under the age of 16 are not permitted to attend AusFitness Industry without prior approval from the organisers.
- Admittance to AusFitness Expo is open to the general public.
- We reserve the right to refuse or revoke entry to anyone at our discretion, including for breach of these Terms.
4. Registration Process
- Registration is required for all attendees, whether the event is free or paid.
- Ticket types, availability, and conditions may vary. Registration is not confirmed until receipt of a confirmation email.
5. Ticketing Provider
Registration for this Event is facilitated by our authorised ticketing provider, Lüp Tickets. By registering, you may be subject to Lüp’s separate Terms of Use and Privacy Policy.
While Lüp provides the ticketing platform, National Media remains responsible for the overall delivery of the Event.
Any issues with ticket processing or confirmations should first be directed to us at [insert contact email], but may also involve coordination with Lüp Tickets where appropriate.
6. Fees and Payments
All ticket fees (if applicable) must be paid in full before the Event.
Fees are quoted in AUD and inclusive of GST unless stated otherwise.
We reserve the right to vary ticket prices without notice.
7. Refunds, Transfers & Cancellations
We do not offer refunds except as required under the Australian Consumer Law (ACL).
Where the Event is cancelled, we will offer a refund or credit.
Where the Event is rescheduled, we will offer ticket transfer for the rescheduled date. If you are unable to attend the rescheduled Event, we will offer a refund or credit.
Where the Event is cancelled, or rescheduled or significantly relocated, all liability is limited to the amount for which the ticket was purchased, less any applicable fees.
Name changes or ticket transfers are permitted with written notice up to 48 hours prior to the Event.
8. Program Changes
The Event program is subject to change without notice. We reserve the right to vary speakers, schedule, venue, or format.
No refunds or compensation will be provided for change to the Event program.
9. Health & Safety
You must comply with all health and safety protocols in place, including public health orders and COVID-19 requirements.
Entry may be refused if you do not comply or pose a risk to others.
10. Code of Conduct
We maintain a zero-tolerance policy for harassment, abuse, unsafe, disruptive, or illegal behaviour.
Anyone failing to meet behavioural standards may be removed from the Event without refund.
11. Photography and Filming
The Event may be photographed or filmed. By attending, you consent to your image being used in marketing.
If you wish to opt-out, notify us in writing prior to the Event.
12. Intellectual Property
All Event content, presentations, logos, and materials remain the intellectual property of the organiser or respective speaker.
You may not record, reproduce, or distribute content without written permission.
13. Force Majeure
We are not liable for delays or cancellations due to events beyond our control, including natural disasters, strikes, pandemics, or government restrictions.
In such cases, we will offer reasonable alternatives including rescheduling or credit.
14. Limitation of Liability
To the extent permitted by law, we exclude all liability for indirect or consequential loss.
Our total liability is limited to the ticket price paid.
Nothing in these Terms limits your rights under the ACL.
Children:AusFitness Expo is predominantly an adult event although we do allow young visitors on-site. We ask that all children under the age of 18 follow our terms of entry policy.
- Children 12 and under must be accompanied by a parent or guardian over the age of 18 at all times while at the AusFitness Expo.
- All children must have a valid child ticket to enter the event. Children aged 12 and under can enter for free but must be accompanied by an adult with a valid ticket.
- Children 12 and under are not permitted to use any exercise equipment or participate in any fitness activities without the direct supervision of a parent or guardian.
The use of any hazardous equipment or materials is strictly prohibited for children, including but not limited to treadmills, weights, dumbbells, technology and sharp objects.
Parents or guardians are responsible for the behaviour of their children at all times. Any damage caused by a child will be the responsibility of the parent or guardian and may result in ejection from the event.
AusFitness Expo reserves the right to ask any child to leave the event if their behaviour is disruptive, dangerous, or inappropriate. In such cases, the parent or guardian will also be asked to leave the event with the child.
By entering AusFitness Expo, children and their parents or guardians agree to abide by these terms of entry. Under no circumstances are any children permitted into the exhibition halls during ‘move in’ and ‘move out’ of the Events. The organiser takes no responsibility for any accidents or injuries onsite.
Competitions and Workouts
Waiver of Liability
In consideration of your attendance and participation in AusFitness Expo and AusFitness Industry (herein called “AusFitness”), including but not limited to the fitness activities, competitions, activations and workouts (herein called “Activities”) held at AusFitness, you acknowledge and agree to the following:
Attendance at AusFitness and participation in the Activities may expose you to risks of bodily or personal injury, including injury that may be fatal, that may not be caused by or arising from any action or negligence of AusFitness. You understand that: The dangers, hazards and inherent risks associated with the Activities to which I may be exposed include, for example, strains, sprains, broken bones, heat stroke, concussion and heart attack; and you may also be exposed to other risks which may or may not be foreseeable, and that even whilst AusFitness may have taken reasonable measures to reduce such risks, certain risks may still exist and cannot be entirely eliminated, collectively referred to as ‘Risks’. Your attendance at AusFitness and participation in Activities is entirely voluntary and you expressly assume and accept all risks associated. You also acknowledge that you have been advised to discuss the risks of participation in the Activities with your healthcare professional.
You expressly assume all risks and responsibility for any damages, liabilities, losses or expense which incur as a result or in connection with your entry into AusFitness and/or participation in the Activities. You represent and warrant to AusFitness that: you are in good health; and not aware of, and/or have no reason to believe that you have or are suffering from any medical condition (including any infectious disease or other ailments) that could affect you or any party’s safe attendance at AusFitness and/or participation in the Activities; you are physically fit and sufficiently trained to participate in the Activities; you may be liable to another participant for any injury or damage that you may cause (whether intentionally or otherwise) to them in the course of my participation in the Activities; and you shall comply with any and all terms, conditions, guidelines, rules and/or instructions pertaining to your attendance at AusFitness and/or your participation in the Activities. To the maximum extent permitted under applicable law, on behalf of yourself, your personal representatives and your heirs, you hereby waive, release, discharge and covenant not to sue or claim against AusFitness, its affiliates, the relevant venue owner(s) and/or operator(s) and each of their respective officers, directors, employees, contractors, representatives, agents and servants (collectively, the “AusFitness Parties”) for any and all liabilities, claims, demands, losses or damages of whatsoever nature, howsoever caused including but not limited to negligence and based on any theory of law (“Losses”) arising out of or in connection with my participation in the Activities.
You further agree to fully indemnify, keep indemnified and hold harmless the AusFitness Parties from any and all Losses resulting from any act or omission by you in connection with or in association with the Activities, which amounts to a breach or violation of any AusFitness policy or rule or which is otherwise unlawful.
In the event of any accident, emergency or any other health or safety exigencies, you consent to the administration of any assistance or services (including medical assistance and first-aid services) that AusFitness Parties deem necessary. Any such assistance or services rendered by the AusFitness Parties shall not be taken to be an admission of liability. You further consent to the collection, use and/or disclosure of your personal data (including without limitation my medical or health information) by the AusFitness Parties and any such medical treatment and/or service providers in connection with the rendering of treatment and/or services in accordance with the foregoing. For the avoidance of doubt, you acknowledge and agree that this consent supplements but does not supersede nor replace any other consents that you may have previously provided to any AusFitness Parties in connection with any collection, use and/or disclosure of your personal data, and any consents that you have provided herein are cumulative and in addition to any rights which the AusFitness Parties may have under applicable law to collect, use and/or disclose your personal data.
Participants must not engage in any behaviour that could be considered dangerous or inappropriate, such as aggressive behaviour towards other participants or judges, use of illegal substances, or any behaviour that could damage the competition and workout area or equipment.
AusFitness Expo reserves the right to disqualify or eject from the event any participant who fails to comply with these terms of entry or who engages in any behaviour deemed to be unsafe, inappropriate or unfair.
By participating in a competition or workout, you agree to abide by these terms of entry. The organiser takes no responsibility for any accidents or injuries onsite.
15. Privacy and Data Use
We collect and handle your data per our Privacy Policy. This includes registration, communication, marketing, and data sharing with approved exhibitors or sponsors.
You may opt out of marketing at any time.
16. Governing Law
These Terms are governed by the laws of the Australian State or Territory in which the Event is held. You submit to the non-exclusive jurisdiction of the courts in that location.
